COMMERCIAL AND COMMUNITY ADR

Ironically, we can have tension with the very people we have already chosen to engage with, such as in business or in our private lives. It could be a company trying to make money or a charity trying to help others.


There is no guarantee that it will remain harmonious and Alternative Dispute Resolution (ADR) is a valuable outlet. Sometimes it is called Appropriate Dispute Resolution, and mediation is
part of ADR in addition to other non-court methods such as arbitration.


Examples of such relationships are a board of directors, partnerships, landlord and tenant, boundary and right-of-way disputes, neighbours, and voluntary organisations such as sports’ clubs and residents’ associations.


Often it is hard to fit such grievances easily into a court action. If it does end up in court judges are keen to salvage any goodwill by having the dispute settled and will
suggest mediation.
